Immigration Evaluation

Lupita Martinez, LMFT can assist individuals currently working on gathering information prior to submitting their immigration forms. She is able to provide a supplemental psychosocial evaluation that can sometimes help your immigration case. Typically, these evaluations are recommended by immigration attorneys or paralegals; please speak to them to verify that an evaluation is recommended for your case.

Immigration evaluations can be used for Asylum, Domestic Violence, U-Visa, T-Visa, and Extreme Hardship waivers. Lupita Martinez, LMFT works with your immigration lawyer or paralegal by providing them with this evaluation. Written consent will need to be granted by each Client being evaluated before communication with the paralegal commences. Both the Client and the immigration lawyer/paralegal will be provided with a signed copy of the evaluation once it is completed.

These psychosocial evaluations consist of 15-35 pages demonstrating the emotional and psychological impact of separating families in response to the immigration process. Deportation or country re-location are typical, thus Lupita Martinez, LMFT assesses the impact this would have on the individual being evaluated.

If you do not understand the process, below are the steps to Lupita Martinez, LMFT’s process:

  1. The Client being evaluated and Lupita Martinez, LMFT (Evaluator) will book TWO (2) appointments for two (2) hours each- a total of four (4) hours. Note: The two appointments must be scheduled within two weeks from each other.

  2. Evaluator will ask for an email to send the forms via a secure online-portal to complete consent forms and intake forms prior to the first appointment

  3. During the first and second appointment, Evaluator will gather personal information about the Client and specifics related to the immigration case. The second appointment will also include psychological assessments that gather specific information on the Client’s mental health.

  4. Evaluator will work on the evaluation for two weeks after the last scheduled appointment. If appointment is rescheduled, the two weeks will adjust to the newly scheduled appointment.

  5. Evaluator will likely have follow up phone calls if there is any missing information for the evaluation. Please make sure to answer phone calls and return voicemails when the Evaluator calls. If your evaluation is for a hardship waiver, please refrain from leaving the country as this will delay the communication thus delay the completion of your evaluation.

  6. Evaluator will send a draft to the Immigration Attorney/Paralegal in order to cross-reference information (dates, names, etc.) to ensure the evaluation information is consistent with Immigration Attorney/Paralegal information. Note: No changes to the diagnosis or treatment recommendations will be made.

  7. If all goes as planned, the entire process from first appointment to mailing the final signed evaluation to both the Client and the Immigration Attorney/ Paralegal will take 4-5 weeks.
